Terms of Service

These terms (the “Terms”) apply to your use of rabbitholelandscaping.com and to all quotes, landscaping and hardscaping services, permaculture work, irrigation, bulk deliveries, and Compostia compost pickup provided by Rabbit Hole Landscaping (“we,” “us,” “our”). By using our site, requesting a quote, or booking with us, you agree to these Terms on behalf of yourself and anyone you’re booking for. Please read the waiver and liability sections carefully — they affect your legal rights.

Quotes & estimates

Prices shown on this site — including the delivery calculator — are estimates. They’re a good-faith guide based on current material costs and the information you provide. The final price is confirmed in writing when we schedule your service or delivery. Material prices can change with the market and quarry rates, and a quote may be revised if site conditions, scope, or access differ from what was described.

Scheduling & service

We serve Athens and the surrounding Northeast Georgia area. Scheduling depends on weather, season, ground conditions, and availability. We’ll always do our best to keep you informed of timing and any changes, but we can’t guarantee specific dates or times and aren’t responsible for delays outside our reasonable control.

Bulk delivery

  • Deliveries are capped at up to 5 cubic yards or 7,000 lb per load; heavier materials may cap at fewer yards. Larger orders ship in multiple loads.
  • The delivery fee is a flat truck fee plus a per-loaded-mile charge from our Athens yard, as shown at the time of booking.
  • We deliver to an accessible, legal drop spot on your property. You’re responsible for ensuring access and a suitable place to receive the material.
  • Natural materials vary in color, texture, and moisture; volumes are approximate.

Property access & site conditions

You’re responsible for telling us where to go and what to watch out for, and for making sure the route and drop spot can safely take a loaded truck or equipment. By booking, you give us permission to enter the property to perform the work.

Heavy trucks and equipment can mark or rut driveways, lawns, and soft or wet ground. To the fullest extent permitted by law, you release us from responsibility for ordinary, unavoidable wear or marks to driveways, curbs, lawns, turf, soil compaction, and similar surfaces along the access route and at the drop or work area when we’re following your directions. If you have a fragile driveway, septic field, drain lines, or soft ground, tell us before we arrive so we can plan around it.

Underground utilities & private lines

For any digging or ground-disturbing work, public underground utilities should be marked first. In Georgia you can call 811 (or 1-800-282-7411) for a free locate, and we’ll coordinate this where required. The 811 locate does not cover private, unmarked lines. You agree to identify, in advance, the location of any private underground items such as irrigation/sprinkler lines, invisible pet-fence wire, low-voltage landscape lighting, private water, gas, or electric runs, drain tile, septic tanks and fields, cable, and similar. To the fullest extent permitted by law, we are not liable for damage to private or unmarked lines and features whose location wasn’t disclosed to us.

Plants, lawns & horticultural results

Plants, trees, sod, seed, and soil are living things, and results depend on weather, watering, pests, soil, and care after we leave — much of which is outside our control. We install and plant with skill, but we can’t and don’t guarantee growth, survival, yield, or specific results unless we’ve agreed to a specific written warranty for that job. Once work is complete, ongoing watering and care are your responsibility.

Compostia compost pickup

  • Please add only accepted materials to your bucket (fruit & veg scraps, coffee, eggshells, and the other items listed on our Compostia page). Keep out meat, fish, bones, dairy, grease, pet waste, plastics, and “compostable” plastics.
  • Contaminated buckets (non-compostable items, hazardous material, or excessive non-organics) may not be collected, and repeated contamination may pause or end service. You’re responsible for what goes in the bucket.
  • Have your bucket out and accessible by your scheduled time. Missed pickups due to an inaccessible bucket, weather, or holidays are caught on the next normal route; we don’t credit individual missed weeks unless we caused the miss.
  • Buckets remain our property; please keep them reasonably clean and return them if you cancel. Finished compost returned to members is offered “as available.”
  • Subscriptions bill on a recurring basis through our payment processor until you cancel. You can cancel anytime before your next billing date.

Assumption of risk & release

Landscaping, hardscaping, and delivery involve heavy materials, equipment, tools, and outdoor conditions. To the fullest extent permitted by Georgia law, you assume the ordinary risks of having this work done on your property and, on behalf of yourself and your household, release and hold harmless Rabbit Hole Landscaping and its owners, employees, and contractors from claims for loss or damage arising from those ordinary risks, except to the extent caused by our gross negligence or willful misconduct. Please keep children and pets away from active work areas and equipment.

Indemnification

You agree to indemnify and hold us harmless from third-party claims, costs, and reasonable attorneys’ fees arising out of your breach of these Terms, your failure to disclose private underground lines or hazards, or your misuse of materials or finished work after we leave.

Warranty disclaimer

Except for any specific written warranty we expressly give for a job, our services and any materials are provided “as is” and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

Payment

Payment terms are provided at the time of booking. Unless otherwise agreed, payment is due on completion of service or at delivery. Subscriptions and online bookings are billed through our third-party payment processors. Past-due balances may pause service.

Cancellations

Need to reschedule or cancel? Just let us know as soon as you can so we can offer the slot to someone else. We may ask for reasonable notice on larger jobs and deliveries, and a deposit (where taken) may be non-refundable for custom orders or materials already sourced.

Photo & media release

We sometimes photograph completed work for our portfolio and marketing. By default we keep these general (the yard, not your name or address). If you’d prefer we not photograph your property, just tell us and we’ll honor it.

Text messages & communications

When you give us your phone number, you agree we may contact you by phone, text, and email about your request, quote, scheduling, and service. If you also opt in to marketing texts, message frequency varies and message & data rates may apply — reply STOP to opt out or HELP for help at any time. See our Privacy Policy for details. Consent to marketing texts isn’t a condition of buying anything from us.

Limitation of liability

We carry out our work with care and skill. To the fullest extent permitted by law, Rabbit Hole Landscaping is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim is limited to the amount you paid for the specific service or delivery giving rise to the claim. Nothing in these Terms limits liability that can’t be limited under Georgia law.

Force majeure

We’re not responsible for delays or failures caused by events beyond our reasonable control — including severe weather, drought or watering restrictions, floods, supply or quarry shortages, equipment failure, utility outages, illness, or government action.

Governing law & disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that any dispute will be handled in the state or federal courts located in or serving Clarke County, Georgia. Before filing anything, please reach out — most issues are easiest to fix with a phone call.

Changes, severability & entire agreement

We may update these Terms from time to time; the “last updated” date above reflects the most recent change, and continued use means you accept the current version. If any part of these Terms is found unenforceable, the rest stays in effect. Any written quote, work order, or invoice we agree on together, together with these Terms, is the entire agreement between us for that work.
